ShareNational Instant Criminal Background Check System Improvement Amendment Act of 2007 (HR 2640)

This law offers more than $1 billion in grant money to states to improve their tracking and reporting of those prohibited from purchasing a gun to the National Instant Criminal Background Check System (NICS), including those persons with mental illnesses.

The original NICS bill has specified the types of behavioral health issues that would bar gun possession; these apply to any person who has been found by a court, commission, or other lawful authority to be criminally insane, unfit to stand trial, or otherwise mentally incompetent. This new law authorizes $250 million a year for five years to states to mitigate the costs of providing such records. It also withholds federal crime fighting funds if the states do not cooperate.
