Medicare & Medicaid Programs; Hospital Conditions of Participation:
Patients Rights
The patients' rights regulations set forth new, more rigorous
training requirements to assure the appropriateness of the treatment
and to protect patient rights. The rule applies to all participating
hospitals including short-term, psychiatric, rehabilitation,
long-term, children's and alcohol/drug treatment facilities. In
response to the 4,000 public comments received on the interim final
rule, this final regulation includes the following provisions:

Staff training requirements are strengthened

Staff training components are specified
-
Increases the types of practitioners who may conduct patient
evaluations when a restraint or seclusion tactic has been
implemented
-
Stricter standards for reporting the death of a patient who had
been restrained or secluded
